Terms and Conditions
1. DEFINITIONS
In these Terms and Conditions:
- "We/Us/Our" means Lele’s Playworld, ABN: 44318721901, operating in New South Wales
- "You/Your/Hirer" means the person or entity hiring the Equipment
- "Equipment" means all soft play equipment, foam blocks, ball pits, toddler slides, and associated items designed for children aged 0-6 years
- "Hire Period" means the period specified in the Booking Confirmation
- "Venue" means the location where Equipment will be delivered and used
- "Supervising Adult" means a responsible person aged 18 years or over designated to supervise Equipment use
2. BOOKING AND PAYMENT
2.1 Bookings are confirmed only upon receipt of:
- Completed booking form with all required details
- Our written confirmation
- Non-refundable deposit of $150 paid within 24 hours
- Acceptance of these Terms and Conditions
2.2 All bookings include a standard 4-hour hire period, which does not include the time required for setup and pack-down. If You require additional hire time beyond the 4 hours, this can be arranged in advance and will incur an additional charge.
2.3 Full payment (including an additional $200 security bond) is due 7 days before the hire date unless otherwise agreed in writing.
2.4 If the remaining hire fee is not paid at least 7 days prior to the event, the booking will be automatically cancelled.
2.5 For bookings made within 7 days of the event, full payment is required within 24 hours of booking.
2.6 All prices quoted include GST.
2.7 We accept payment via credit/debit card, Apple Pay, Klarna, and PayPal. All payments must be made using one of these approved methods unless otherwise agreed in writing.
2.8 Late payment consequences:
- Bookings with outstanding balances may be cancelled without refund of paid funds
- Equipment delivery may be refused until full payment is received
2.9 A $200 security bond is required for Equipment hire. This amount will be fully refunded, provided all Equipment is returned undamaged and in its original condition.
3. DELIVERY, SETUP AND COLLECTION - NSW REQUIREMENTS
3.1 We will deliver and install Equipment at the agreed time and Venue
3.2 A setup period of approximately 1–2 hours is required prior to the commencement of the event. An additional 1–2 hours will be required following the conclusion of the event for dismantling, cleaning, and collection of equipment.
3.3 Setup requirements You must provide:
- Clear, level access minimum 1.2 metres wide with no stairs or steep inclines
- Setup area that is flat, clean, dry, and free from rocks, sticks, or sharp objects
- Minimum clearance of 2 metres on all sides of Equipment
- Overhead clearance of 4 metres (no trees, wires, or structures)
- Shade or undercover area recommended for sun protection
3.4 A Supervising Adult must be present throughout delivery and collection.
3.5 The Hirer agrees not to move or rearrange the Equipment, as doing so may result in injury or damage.
3.6 Collection will occur at agreed time. Equipment must be empty of users and personal items by this time.
3.7 Additional charges apply for:
- Difficult access requiring extra labour: $50 per half hour
- Setup outside standard hours (10am-6pm): $75 surcharge
- Excessive cleaning required: $100 minimum
- Late collection due to Your delay: $50 per half hour
- Travel to locations more than 20km beyond our standard service area (postcode 2179) – this will be quoted at the time of booking
4. AGE-SPECIFIC SUPERVISION REQUIREMENTS (0-6 YEARS)
4.1 Mandatory Supervision Ratios:
- Ages 0-2 years: 1 adult per 2 children (within arm's reach supervision)
- Ages 3-6 years: 1 adult per 4 children (active supervision)
- Mixed age groups: Apply the ratio for youngest children present
4.2 Supervising Adults must:
- Remain within direct sight of Equipment at all times
- Actively monitor children's behaviour and safety
- Ensure age groups are appropriately separated
- Prevent older children (over 6) from using Equipment
- Remove any child displaying unsafe behaviour
- Not be under the influence of alcohol
4.3 Specific Requirements for Toddlers (0-2 years):
- Must be closely supervised by parent/guardian
- Crawlers must be separated from walking children
- No bottles, dummies, or hard toys on Equipment
5. HIRER'S RESPONSIBILITIES UNDER NSW LAW
5.1 You must ensure:
- All children remove shoes, jewellery, hair clips and sharp objects
- No high heels to be worn in the play area
- No food, drinks, or chewing gum on or near Equipment
- No face paint, silly string, streamers, sand or glitter to be used anywhere near the soft play area. These items cause permanent staining on Equipment and as such we reserve the right to cancel your booking should activities involving those listed be on site or lined up
- No cartwheels, flips or other type of acrobatics near or inside the equipment.
- Entrances and exits of Equipment must be kept clear at all times.
- Children with runny noses, infectious conditions, or nappy rash do not use Equipment
- Nappies are secure and covered by clothing
- Maximum capacity limits are never exceeded
- Equipment remains secure throughout hire
- Weather conditions are monitored
- No alcohol, barbecues or smoking on or near the Equipment
5.2 You must not:
- Allow children over 6 years to use Equipment
- Move or modify Equipment after installation
- Allow rough play, climbing on walls, or throwing of soft play items
- Use Equipment during rain, storms, or high winds
- Allow pets on or near Equipment
5.3 For events in public spaces, You must obtain relevant NSW council permits.
5.4 The Hirer agrees to use the equipment solely for its intended purpose and only in locations deemed suitable by Us
6. WEATHER AND ENVIRONMENTAL CONDITIONS
6.1 Under NSW safety requirements, Equipment must not be used when:
- During rain, storms, or lightning
- Temperature exceeds 38°C
- Equipment becomes wet or slippery
6.2 You must monitor weather conditions using Bureau of Meteorology updates.
6.3 We reserve the right to cancel or remove Equipment for safety reasons.
6.4 Weather-related rescheduling is permitted with 24 hours notice.
7. DAMAGE, LIABILITY AND INDEMNITY
7.1 You are liable for damage beyond normal wear and tear including:
- Tears or punctures: $150-$500 depending on size
- Biohazard cleaning (vomit/faeces): $200 minimum
- Partial/Total Equipment loss or damage: full replacement cost
7.2 Our liability is limited to the hire fee except where prohibited by Australian Consumer Law.
7.3 You indemnify Us against all claims arising from:
- Breach of these Terms and Conditions
- Failure to provide adequate supervision
- Allowing over-age children to use Equipment
- Negligent use or safety breaches
- Breach of NSW Work Health and Safety obligations
7.4 This indemnity survives termination of the hire agreement.
8. INSURANCE REQUIREMENTS UNDER NSW LAW
8.1 We maintain public liability insurance of $20 million as required for NSW amusement device operators but it does not cover negligence or supervision failures.
8.2 You are strongly advised to obtain Your own public liability insurance for the event.
8.3 For commercial events or childcare centres, evidence of Your insurance is mandatory.
8.4 Any incidents must be reported to Us immediately for insurance purposes.
9. NSW CIVIL LIABILITY ACT 2002 - RISK WARNING
9.1 Under the NSW Civil Liability Act 2002, You acknowledge that:
- Recreational activities carry inherent risks
- Children can be unpredictable and accidents may occur despite supervision
- Soft play activities involve risk of collision, falls, and minor injuries
9.2 You voluntarily assume these risks for all children under Your supervision.
9.3 You warrant having authority to accept risk on behalf of all Equipment users.
9.4 While Public Liability Insurance is maintained, the Hirer accepts full responsibility for any damage, personal injury or death arising from misuse, negligence, or failure to follow safety guidelines during the hire period. It is the Hirer’s obligation to ensure that all users comply with the provided safety instructions at all times.
10. HYGIENE AND HEALTH REQUIREMENTS
10.1 In accordance with NSW health guidelines:
- Equipment is cleaned and sanitised between hires
- You must not allow visibly unwell children to use Equipment
- Hand sanitiser should be used before Equipment use
- Any contamination must be reported immediately
10.2 You agree to notify Us if any child using Equipment develops a contagious illness within 48 hours.
11. CANCELLATION AND REFUND POLICY
11.1 By You:
- More than 7 days notice: Full refund (deposit not included)
- 3-7 days notice: 50% refund of total cost
- Less than 3 days: No refund (full payment required)
- Security bond will be refunded in all instances
11.2 By Us:
- Equipment failure: Full refund or alternative Equipment
- Safety concerns prohibiting Equipment installation: forfeiture of paid funds
- Weather (NSW SafeWork wind limits exceeded): Full credit for rebooking within 6 months
11.3 Government restrictions:
- Full credit valid for 12 months.
12. PRIVACY AND PHOTOGRAPHS
12.1 We comply with the Privacy Act 1988 (Cth) and NSW privacy legislation.
12.2 Any personal information You provide will be used solely for the purposes of managing Your booking, including communication, invoicing, and event coordination. We do not share Your information with third parties, except where required by law or directly related to the provision of Our services.
12.3 All personal information is stored securely and only accessible by authorised personnel for business purposes.
12.4 You may request access to or correction of the personal information We hold about You by contacting Us.
12.5 We may photograph Equipment setup for:
- Safety compliance records
- Insurance documentation
- Marketing (no children identifiable without written consent)
12.6 By booking with Us, You consent to the use of event photos for promotional purposes, including advertising, social media, and Our website. If photos are provided by Your photographer, You confirm permission has been granted and credit will be given.
12.7 You may opt out of marketing photography by written notice.
13. GENERAL TERMS
13.1 These Terms constitute the entire agreement between parties.
13.2 No variations unless agreed in writing by both parties.
13.3 If any clause is unenforceable, remaining clauses continue in effect.
13.4 We retain title to all Equipment at all times.
13.5 These Terms comply with Australian Consumer Law - statutory rights cannot be excluded.
14. GOVERNING LAW AND JURISDICTION
14.1 This agreement is governed by the laws of New South Wales.
15. HEALTH AND SAFETY DECLARATION
By agreeing to these Terms and Conditions, You declare and warrant that:
- You have read and understood all Terms and safety requirements
- You will ensure adequate supervision ratios are maintained
- All children using Equipment are within the 0-6 year age range
- You understand Your obligations under NSW Work Health and Safety laws
- You have authority to sign on behalf of the hiring entity
- You will comply with all NSW SafeWork requirements for amusement devices
RULES OF PLAY
To ensure a safe and fun experience for all children, please carefully observe the following rules while using our equipment:
1. Age Restrictions:
- Only children aged 0 to 6 years are permitted to use the equipment.- Children over 6 years are strictly not allowed.
2. Supervision:
- A Supervising Adult (18 years or older) must be present at all times, maintaining direct sight and active supervision of children.3. Safety and Behaviour:
- No pushing, shoving, wrestling, cartwheels, flips, or any other rough play inside the equipment.
- No climbing on walls or outside surfaces of the equipment.
- Users must wait their turn and avoid overcrowding the equipment.
- Entrances and exits of Equipment must be kept clear at all times.
4. Hygiene and Attire:
- All children must remove shoes, jewellery, hair clips, and any sharp objects before entering the play area.
- No food, drinks, chewing gum, face paint, silly string, streamers, sand, or glitter allowed on or near the equipment.
- Children with runny noses, infectious conditions, or nappy rash should not use the equipment. Nappies must be securely covered by clothing.
5. Equipment Integrity:
- Do not move, modify, or rearrange any equipment after setup.
- No throwing of soft play items
- Equipment must remain secure throughout the hire period.
6. Weather Conditions:
- Equipment must not be used during rain, storms, high winds, or temperatures above 38°C.
- The hirer is responsible for monitoring weather and notifying Lele’s Playworld of unsafe conditions.
7. Prohibited Items and Activities:
- No alcohol, barbecues, smoking, or pets are allowed on or near the equipment or venue.
- No bottles, dummies, or hard toys inside the play area.
8. Compliance:
- All rules align with NSW Work Health and Safety requirements and Lele’s Playworld Terms and Conditions.- Failure to comply may result in immediate cessation of equipment use without refund.
